General terms and conditions of the company Mamamoon Retreats

§1 Validity vis-à-vis entrepreneurs and definitions of terms

(1) The following General Terms and Conditions shall apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes which cannot predominantly be attributed to either his commercial or his self-employed professional activity (§ 13 BGB).

§2 Conclusion of a contract, storage of the contract text

(1) The following provisions on the conclusion of a contract apply to orders placed via our Internet shop https://www.mamamoon.me .

 

(2) In the case of the conclusion of a contract, the contract is concluded with

(3) The presentation of the goods in our Internet shop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a sales contract.

The offer is accepted in writing or in text form or by sending the ordered goods within one week. After fruitless expiration of the deadline, the offer shall be deemed rejected.

 

(4) Upon receipt of an order in our Internet shop, the following provisions shall apply: The consumer submits a binding contractual offer by successfully completing the order procedure provided for in our Internet shop.

 

The order takes place in the following steps:

1) Selection of the desired goods
2) Confirm by clicking on the buttons "Order". 
3) Checking the information in the shopping cart
4) Press the button "Checkout". 
5) Login to the internet shop after registration and entry of the login details (e-mail address and password). 
6) Re-examination or correction of the data entered.
7) Binding dispatch of the order by clicking on the button "order for a fee" or "buy".

Before the binding dispatch of the order, the consumer can return to the website on which the customer's details are recorded and correct input errors or cancel the order process by closing the Internet browser by pressing the "Back" button contained in the Internet browser used by him after checking his details. We confirm the receipt of the order immediately by an automatically generated e-mail (confirmation of receipt). This does not yet represent acceptance of the offer. The acceptance of the offer takes place in writing, in text form or by sending the ordered goods within one week. 

 

(5) Storage of the contract text with orders over our Internet shop: We send you the order data by E-Mail. You can also view the general terms and conditions at any time at https://www.mamamoon.me/terms-conditions. For security reasons, your order data is no longer accessible via the Internet. 

 

§3 Prices, shipping costs, payment, payment due date

(1) The indicated prices include the legal value added tax and other price components. Any shipping costs shall be added.

(2) The consumer has the possibility of payment by PayPal, credit card (Visa, Mastercard).

(3) Payment is due in full at the time of booking one of our Mamamoon services.

§4 Retreat Participation Conditions

By booking one of our Mamamoon Retreats events or services, participants confirm that they are doing so out of their own free will and with the understanding that this is a program is designed to teach them to use their own natural abilities to bring their mind and body into a state of relaxation and self-reflection. They further confirm that they understand that the content of these classes is in no way intended to be represented as medical advice nor as a prescription for medical procedure. By booking our services, they confirm that they are aware that they should seek the advice of a health-care provider to answer any physical or mental health-related or pregnancy-related issues surrounding their pregnancy, labor, birth or post-partum.

By booking our services, participants therefore agree that they will in no way hold the instructors of the Mamamoon Retreats, its owners, or its representatives responsible for any special circumstances that could arise as a result of participating in this retreat, or as a result of their pregnancy, labor, or birth of their child, as well as any issues coming up during their post-partum period and beyond. Participants agree that neither they nor any member of their family will make any claim or initiate any suit against any of the above-named parties now or at any time in the future.

 

By booking our services and participating in one of our events, participants consent that pictures and/ or videos of them might be taken, and that these might be used for marketing and advertising purposes on Mamamoon's online channels (Facebook, Twitter, Instagram, www.mamamoon.me etc.) as well as on other marketing materials. 

§5 Delivery of our services

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are immediately ready for dispatch. The delivery takes place here at the latest within 5 working days. In case of payment in advance, the delivery period begins on the day following the payment order to the bank commissioned with the transfer and, in case of all other payment methods, on the day following the conclusion of the contract. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline shall end on the next working day.

(2) The risk of accidental loss and accidental deterioration of the goods sold shall not pass to the Buyer until the goods are handed over to the Buyer, even in the case of sale by delivery to destination. 

​

§6 Retention of title

We reserve title to the goods until the purchase price has been paid in full. 

§7 Right of revocation of the customer as consumer

Consumers are entitled to a right of revocation in accordance with the following provision, whereby a consumer is any natural person who concludes a legal transaction for purposes which can predominantly be attributed neither to his commercial nor his self-employed professional activity:

You have the right to revoke this contract within fourteen days without giving reasons. 
The revocation period is fourteen days from the date of conclusion of the contract.

by means of a clear statement (e.g. a letter or e-mail) of your decision to revoke this Agreement. You can use the attached sample revocation form, which is not mandatory. 

In order to comply with the revocation period, it is sufficient for you to send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of revocation

If you revoke this Agreement, we shall reimburse you immediately and no later than fourteen days from the date on which we received notice of your revocation of this Agreement for all payments we have received from you, including delivery charges (other than additional charges arising from your choice of a method of delivery other than the cheapest standard delivery offered by us). We will use the same means of payment used by you in the original transaction for such refund, unless expressly agreed otherwise with you and in no event will you be charged for such refund.

Cancellation policy

For cancellation of participation in one of our events, we handle the following cancellation and refund policy: 

Cancellation more than 4 weeks before the start date of the event or retreat: 50% refund of paid event participation price.

Cancellation 4 weeks or less before the start date of the event or retreat: no refund will be granted.
